Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of FluxEdit, including our bots, websites, editing tools, generative features, paid features, and related services (collectively, the “Service”).
By accessing or using the Service, submitting content for processing, or purchasing a paid feature, you agree to these Terms. If you do not agree, do not use the Service.
These Terms should be read together with our Privacy Policy, Acceptable Use Policy, and AI Transparency Notice. Those documents form part of the rules that apply to your use of FluxEdit.

The Service
FluxEdit provides AI-assisted photo and video editing and generative-media features. Depending on the feature, you may be able to use presets, submit custom instructions, animate media, purchase access or credits, or use related functionality made available through FluxEdit.
The Service may currently be accessed through third-party interfaces, including messaging platforms. The interface through which you access FluxEdit is not necessarily the Service itself and may change over time.
We may offer demonstration experiences using example or test media. A demo is intended to show how a feature works. It does not guarantee that the same result, quality, speed, availability, or style will be produced for your own content.

Eligibility: adults only
You may use the Service only if all of the following are true:
- You are at least 18 years old.
- You have reached the legal age of majority in your jurisdiction.
- You are legally permitted to use the Service where you are located.
- You can enter into a binding agreement with us.
The Service is not directed to or intended for minors. You must not allow a minor to access adult features of the Service through your account, device, payment method, or credentials.
If you use the Service on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms.

Access and accounts
Some features may be linked to your account or identifier on a third-party platform, such as a Telegram account, or to a payment or transaction identifier.
You are responsible for maintaining control of the devices, accounts, credentials, and payment methods you use to access the Service. You must not knowingly provide access to restricted or adult features to anyone who is not eligible to use them.
Unless we expressly state otherwise, paid access and user-specific entitlements are personal to the purchasing user and may not be sold, transferred, sublicensed, or commercially redistributed.

Your content and your rights
“User Content” means photos, videos, prompts, text, instructions, and other material you submit to the Service.
You retain any rights you already have in your User Content. You grant FluxEdit a limited, non-exclusive, worldwide, royalty-free license to host, transmit, process, reproduce, modify, and create technical derivatives of User Content only as reasonably necessary to provide, secure, maintain, and support the Service, comply with law, and enforce our policies.
This operational license does not give us ownership of your User Content. Our handling and retention of uploaded media is further described in the Privacy Policy.
By submitting User Content, you confirm that:
- You own it or have the legal rights required to use and submit it.
- Your submission does not violate another person’s privacy, publicity, copyright, or other rights.
- You have obtained any consent required for recognizable people depicted in the content.
- Your use complies with these Terms and our Acceptable Use Policy.

People depicted in content
You must not submit a real person’s image or video for sexualized, intimate, deceptive, humiliating, or otherwise sensitive editing unless you have the legal right to do so and all consent required by applicable law and our policies.
You must never submit or request sexual or exploitative content involving a minor, a person you know or reasonably should know is a minor, or a person whose age is uncertain in circumstances that create a risk of sexualizing a minor.
Additional restrictions, including restrictions concerning non-consensual intimate content, harassment, impersonation, public figures, celebrities, and other sensitive uses, are set out in the Acceptable Use Policy.

Acceptable use
You may use FluxEdit only for lawful purposes and in accordance with our Acceptable Use Policy.
You must not use the Service to:
- Create, request, possess, or facilitate sexual content involving minors.
- Create or facilitate non-consensual intimate or sexualized content.
- Harass, threaten, extort, stalk, exploit, or abuse another person.
- Deceive others through harmful impersonation, fraud, or fabricated evidence.
- Violate privacy, publicity, intellectual-property, or other legal rights.
- Upload illegal material or use the Service for illegal activity.
- Attempt to bypass safety controls, access restrictions, rate limits, or enforcement systems.
- Interfere with the Service, introduce malicious code, scrape restricted systems, or gain unauthorized access.
The Acceptable Use Policy contains the more detailed list of prohibited uses and controls if there is a difference in specificity on an acceptable-use issue.

AI-generated and edited output
FluxEdit uses automated and AI-based systems to generate or modify media. Outputs are synthetic or manipulated media and may be inaccurate, incomplete, unexpected, offensive, visually inconsistent, or unsuitable for your intended purpose.
We do not guarantee that an output will accurately represent a real person, event, identity, age, consent status, or factual circumstance. You must not rely on generated or edited output as factual evidence.
You are responsible for reviewing outputs before using, saving, sharing, or publishing them. Where law, platform rules, or the context of publication requires disclosure that content is AI-generated or materially manipulated, you are responsible for making that disclosure.

Safety systems and enforcement
We may use automated filters, classifiers, rate limits, manual review, blocklists, and other safeguards to detect or prevent prohibited use. These systems are safety tools; they are not definitive legal, identity, consent, or age determinations and may make mistakes.
We may reject a request, restrict a feature, block content, suspend access, or require additional review when we reasonably believe there is a safety, legal, fraud, abuse, or policy risk.
You must not attempt to evade or defeat safety systems. Repeated attempts to bypass restrictions may result in suspension or termination.
If you become aware of prohibited content, suspected abuse, non-consensual use, or another potential violation of our policies, you may report it through the FluxEdit bot using the /report command.

Privacy and content processing
Our Privacy Policy explains what information we process, why we process it, how long we retain it, when it is deleted, which service providers may process it, and the choices or rights available to you.
Uploaded media may need to be transmitted to technical infrastructure or service providers in order to complete generation, editing, safety checks, delivery, retries, or related operational functions. Any specific automatic-deletion period shown in the Service is subject to the conditions and narrowly necessary exceptions described in the Privacy Policy.
We may retain limited non-content records where reasonably necessary for payments, accounting, fraud prevention, security, abuse handling, transaction history, legal compliance, or dispute resolution, even when uploaded media itself is deleted.

Payments, paid access, and refunds
Some features require payment. Prices, currencies, payment methods, purchase type, and material billing conditions will be presented at or before checkout.
By making a purchase, you authorize the applicable payment provider to charge the amount shown at checkout, including any taxes or fees that must be collected from you.
A purchase is recurring only if the checkout clearly identifies it as a subscription or other recurring arrangement and states the applicable renewal terms. Otherwise, a purchase does not create an automatic renewal obligation.
Credits, usage units, or similar digital entitlements have no cash value and are not transferable unless we expressly state otherwise. Any expiration or usage limit will be disclosed with the applicable offer.
Refund eligibility depends on the type of purchase, whether digital performance has begun, the payment method, the terms shown at checkout, and applicable law. Nothing in these Terms removes any mandatory refund, cancellation, withdrawal, or consumer right that applies to you.
We may restrict paid access associated with fraud, unauthorized payments, payment abuse, or bad-faith chargeback activity, subject to applicable law and legitimate dispute rights.
Referral, partner, affiliate, or clone-bot programs, if offered, may be governed by separate terms.

Third-party platforms and providers
The Service may rely on third-party platforms and providers, including messaging services, hosting providers, AI infrastructure, storage providers, payment processors, and other technical services.
Your use of a third-party service is also subject to that provider’s own terms and policies. We do not control third-party services and are not responsible for changes, outages, restrictions, account actions, or other conduct of a third-party provider, except to the extent responsibility cannot lawfully be excluded.
We may replace or change technical providers where reasonably necessary to operate, secure, improve, or maintain the Service.

Intellectual property
FluxEdit and its licensors retain all rights in the Service itself, including software, code, workflows, interfaces, branding, documentation, preset systems, and other proprietary materials, excluding User Content.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.
Rights in AI-generated output can vary by jurisdiction, source material, and applicable third-party terms. To the extent we hold transferable rights in an output generated for you, we do not claim exclusive ownership over that output against you. However, we do not guarantee that any output is copyrightable, unique, free from similarity to third-party material, or suitable for commercial exploitation.
You are responsible for determining whether you have the rights needed for any public, commercial, or downstream use of an output.

Changes to the Service and availability
We may add, remove, update, limit, or discontinue features. We may also perform maintenance or make changes required by safety, legal, provider, infrastructure, or commercial considerations.
We do not promise that the Service will be uninterrupted or available in every country, on every platform, or with every feature at all times.
Where a material change affects a paid entitlement, we will handle the change in accordance with the terms of the applicable purchase and any mandatory consumer rights.

Suspension and termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate access where reasonably necessary because of:
- A serious or repeated breach of these Terms or the Acceptable Use Policy.
- Suspected exploitation of minors or non-consensual intimate-content activity.
- Fraud, payment abuse, security threats, or attempts to bypass safeguards.
- A legal requirement, court order, valid authority request, or provider restriction.
- A material risk to users, third parties, the Service, or our infrastructure.
Where appropriate and legally permitted, we may provide notice or an opportunity to clarify the issue. Immediate action may be taken where delay could create harm, legal exposure, or security risk.
Sections that by their nature should survive termination, including provisions about rights, payments already due, disclaimers, liability, disputes, and general terms, will continue to apply.

Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted availability, a particular generation time, a specific output, perfect moderation, error-free processing, compatibility with every device or platform, or that every generated result will meet your expectations.
FluxEdit is a technology service and does not provide legal advice, identity verification, consent verification, age verification, or a guarantee that your intended use of any content or output is lawful.
Nothing in this section excludes warranties, guarantees, or remedies that cannot legally be excluded.

Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.
To the extent permitted by law, FluxEdit will not be liable for indirect, incidental, special, exemplary, or consequential losses, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from your use of or inability to use the Service.
To the extent permitted by law, we are not responsible for losses caused by your unlawful or prohibited use, your lack of rights or consent in submitted content, your publication or distribution of outputs, or the independent acts or outages of third-party platforms and providers.
For claims arising from a paid feature, and to the extent a monetary cap is permitted by applicable law, FluxEdit’s aggregate liability relating to that paid feature will not exceed the amount you paid to FluxEdit for the affected Service during the 12 months before the event giving rise to the claim.

Additional terms for business users
This section applies only when you use the Service primarily for business or professional purposes rather than as a consumer.
You are responsible for ensuring that your organization’s use of the Service, User Content, and outputs complies with applicable law and the rights of third parties.
To the extent permitted by law, a business user will indemnify and hold FluxEdit harmless from third-party claims, damages, and reasonable costs arising directly from that business user’s unlawful content, infringement of third-party rights, or intentional violation of the Acceptable Use Policy.
This business-user indemnity does not apply to consumer users and does not cover losses caused by FluxEdit’s own unlawful conduct.

Governing law and disputes
Before starting formal proceedings, you may contact us through the FluxEdit bot using the /help command so that we can try to resolve the issue informally.
Unless mandatory law provides otherwise, these Terms are governed by the laws applicable to the legal operator of FluxEdit in the jurisdiction where that operator is established, without giving effect to conflict-of-law principles.
If you are a consumer, this clause does not deprive you of mandatory protections or the right to bring a claim in a court or forum available to you under applicable consumer law.
If you are a business user, disputes will be subject to the competent courts of the jurisdiction in which the legal operator of FluxEdit is established, unless we agree otherwise in writing.

Changes to these Terms
We may update these Terms to reflect changes to the Service, law, safety practices, payment arrangements, providers, or our operations.
The “Effective date” at the top of this page shows when the current version became effective. Where required by law, or where a change materially affects your rights, we will provide additional notice or request renewed acceptance.
Changes do not retroactively remove rights or remedies that you already have under mandatory law.

General terms
Entire agreement
These Terms, together with the policies expressly incorporated into them and any specific purchase terms shown to you, form the agreement governing your use of the Service.
Severability
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply where legally permitted.
No waiver
If we do not enforce a provision immediately, that does not mean we permanently waive the right to enforce it later.
Assignment
You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law and your mandatory rights.
Language
If these Terms are translated, the English version will control to the extent permitted by law, unless mandatory local law requires otherwise.
